At Company's sole discretion, it may require You to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Virginia law, being held in Fairfax county.

All claims subject to arbitration under this Agreement must be brought in an individual capacity only. The parties expressly agree that no arbitration shall proceed on a class, collective, consolidated, or representative basis. The arbitrator shall lack authority to certify any class or collective proceeding, to hear claims as a representative or member of any class, or to consolidate the claims of different individuals. By agreeing to arbitration, each party knowingly and voluntarily waives any right to pursue or participate in class or collective arbitration.
